Landmark Claim by Abused Wife
March 2009- Cameron Fyfe in our Litigation Department is representing an abused wife in a first of its kind case in the Court of Session. June Thomson's husband Robert Thomson murdered their two children, Ryan and Michelle, whilst they were visiting him on a contact visit. Mrs Thomson had left her husband and the matrimonial home after years of physical and mental abuse but had allowed the children a visit with their father. Robert Thomson was found guilty of the children's murders by the High Court in October 2008. June Thomson is pursuing a divorce claim under the relevant legislation. However she is also pursuing a separate personal injury claim in respect of the mental and physical anguish caused by his behaviour and it is that aspect of her case which is ground breaking. Whilst any money secured will not replace the loss of the children, Mrs Thomson feels that it will help secure her future and affect her husband in the way which she feels will hurt him the most, in return for her suffering over the period of the marriage. Cameron Fyfe has commented that if successful he believes there will be an avalanche of similar claims from those who have suffered through abusive relationships.
