Unfortunately many relationships end in separation. Although people are sad that their relationship has come to an end, it is not always a negative experience. For some people their deteriorating relationship has caused them great upset and they wish to resolve matters as quickly as possible and move on with their lives.
When parties split up there are important matters to be decided. The welfare of any children and the division of the parties finance have to be dealt with.Often the time of separation is a very emotional time and decisions that are made at this time are crucial and it is therefore essential to get the correct advice at the correct time.
At Ross Harper the Family Team have the philosophy that, if possible, disputes involving the welfare of children and financial matters should be resolved by way of negotiation with parties entering into a Minute of Agreement reflecting the arrangements that have been discussed. Sometimes it is not possible to negotiate a settlement and a court action will require to be raised but we will only take such action if there is no other route forward. We have an experienced Family Team consisting of five solicitors and two paralegals. There are other support staff to ensure that when you require urgent advice, someone will be on hand to respond to you immediately.
We are aware your case is extremely important to you and we will do our best to deal with your case quickly and efficiently but also sympathetically with a view to minimising the stress that is inevitable in cases of this type.
Family law is constantly changing and recently with the advent of the Civil Partnership Act 2005 and the Family Law (Scotland) Act 2006, there have been many changes to an already complicated set of laws and sometimes, prior to entering into a relationship, it is a good idea to find out about your legal rights.
Other services we supply include the obtaining of interdicts and non harassment orders and Alan Susskind, who is the Partner in charge of the Family Team, is also an accredited mediator. Mediation is an effective way of resolving a dispute where the parties are prepared to come together to try and reach an arrangement without the necessity of utilising the adversorial court process.
